[DELHI RIOTS]Delhi Court takes cognizance of chargesheet under UAPA

• On Tuesday, a Delhi court learned of the charges filed under the Unlawful Activities (Prevention) Act against Umar Khalid, Sharjeel Imam and Faizan Khan in the Delhi riots case, alleging that there is ample evidence to proceed against them (State vs Tahir Hussain).

• Under Sections 13/16/17/18 UAPA, Sections 120B r/w 109/ 114/ 124A/ 147/ 148/ 149/ 153A/ 186/ 201/ 212/ 295/ 302/ 307/ 341/ 353/ 395/ 420/ 427/ 435/ 452/ 454/ 468/ 471/ 34 IPC, 25/27 Weapons Act & 3 / 4 PDPP Act, Delh Police filed a chargesheet earlier this month for the suspected commission of offences.

• However, according to Section 124A/153A/109/120B IPC, the court did not consider cognizance offences as the necessary punishment for the same is still awaited under Section 196 CrPC.
