Clarify stance on recognition of same-sex marriages: Delhi HC to Centre

  • In response to separate pleas by two same-sex couples, one seeking marriage under the Special Marriage Act (SMA) and the other seeking registration of their marriage in the US under the Foreign Marriage Act (FMA), the Delhi High Court today sought the Centre's response.

  • The Centre and the Delhi government were informed by the Bench of Justices RS Endlaw and Asha Menon seeking their position on the petition of two women seeking marriage under the SMA and challenging provisions of the statute to the degree that it does not allow for same-sex marriages.

  • The court also gave notice of the second plea to the Centre and the Consulate General of India in New York of two men who were married in the US but were refused registration under the FMA of their marriage.
