Calcutta HC defends a trespasser's entitlement to electricity

  • Recently, the Calcutta High Court had the ability to decide that even a trespasser is entitled to electricity unless evicted by due process of law (Sukla Kar v. The Calcutta Electric Supply Corporation Ltd. & Ors.)

  • However, Justice Arindam Mukherjee explained that even the award of an electricity link to such an individual does not give rise to any other right in her favour with regard to land.

  • The complainant had moved the High Court in this case after the Calcutta Electric Supply Corporation denied her appeal for a new service link (CESC).
