Bombay HC takes up COVID-19 Emergency parole for POCSO convicts

  • The Bombay High Court's Full Bench is now required to determine if individuals sentenced under the Protections of Children from Sexual Crimes (POCSO) Act are entitled to emergency parole under the Maharashtra Prisons (Mumbai Furlough and Parole (Amendment) Rules, 2020) in view of the COVID-19 pandemic.

  • In view of contradictory decisions on the issue of emergency parole in the middle of the pandemic, the Bench of Justices SS Shinde and MS Karnik referred to the Full Bench.

  • The question emerged when PU Sonale filed a plea opposing the denial of his parole on the basis that, under the terms of the Indian Penal Code ( IPC) and the POCSO Act, for which he was sentenced to 10 years in gaol, he was convicted of raping a minor.
