Bail granted by SC to under trial incarcerated for more than twelve years

  • On Monday the Supreme Court of India granted bail to Rakesh Mishra, an under trial who was incarcerated for 12 years in connection to a crime that was registered in 2009.

  • The Bench comprising Justice A.M. Khanwilkar, Justice B.R. Gavai and Justice Krishna Murari stated “We are appalled to notice that the appellant is in jail for connection with the crime registered by FIR No. 226 of 2009 for more than 12 years and the trial is still not concluded.”

  • The Bench directed, in the interest of justice, for Rakesh Mishra to be released on bail on provisions as may be levied by the trial court.

  • The Trial Court was further directed by the Bench to ensure that the trial is seized and concluded no later than six months from receipt of the copy of the order.
